Terms and Conditions

1. Scope

These Terms and Conditions (hereinafter "Terms") apply to the use of the dotOtel service (hereinafter "Service"), operated by Giesswein Creativ GmbH, Sonnhangweg 41, 6314 Hopfgarten im Brixental, Austria (hereinafter "Provider"). By creating an account or otherwise using the Service, the customer (hereinafter "Customer") accepts these Terms.

2. Description of Services

dotOtel is a hosted, multi-tenant observability platform operated by the Provider on infrastructure located within the European Union. It ingests telemetry signals (logs, traces, metrics) from the Customer's applications via the OpenTelemetry protocol, stores them on the Provider's infrastructure, and exposes a web interface for searching, filtering and visualising the data.

The Service includes:

  • Endpoints for ingesting OpenTelemetry-compatible logs, traces and metrics
  • A web interface for searching logs, exploring traces and charting metrics
  • Per-tenant workspaces with role-based access
  • Configurable retention and ingest tokens
  • Email-based support according to the chosen plan

3. Account and Access

Use of the Service requires a registered account. The Customer is responsible for keeping account credentials and ingest tokens confidential and for any activity performed under its account.

The Customer may not:

  • share account credentials with unauthorized third parties;
  • attempt to gain unauthorized access to other Customers' workspaces or the underlying infrastructure;
  • use the Service to ingest unlawful content or content that infringes third-party rights;
  • use the Service in a way that damages, overburdens or disrupts it.

4. Customer Responsibilities

The Customer is responsible for:

  • Configuring its applications to send telemetry to the Service;
  • Securely handling account credentials and ingest bearer tokens;
  • Choosing which telemetry signals and attributes are submitted, and ensuring this submission complies with applicable data protection laws;
  • Avoiding the transmission of special categories of personal data (Art. 9 GDPR), payment-card data, or other sensitive content via telemetry attributes or log records;
  • Configuring drop rules and retention according to applicable data protection laws.

5. Availability and Maintenance

The Provider operates the Service with reasonable care and aims for high availability, but does not guarantee uninterrupted access. Planned maintenance is announced in advance where reasonably possible. Service-level commitments, if any, are set out in the individually agreed plan.

6. Pricing and Payment

dotOtel is billed strictly pay-per-use. Usage is measured per ingested record and charged monthly via Stripe Billing. The following prices apply (all amounts in euros, excluding statutory value-added tax):

  • Logs: 0.35 € per 1 000 000 records
  • Spans: 0.35 € per 1 000 000 records
  • Datapoints (metrics): 0.12 € per 1 000 000 records

A valid payment method must be on file before the account can ingest data. Payment processing is performed by Stripe Payments Europe Ltd. acting as the Provider's payment service provider. Invoices are issued automatically by Stripe at the end of each billing period. In the event of failed payment, ingest is suspended until the payment method has been updated. Either party may terminate at any time via the Stripe Customer Portal; usage incurred up to the termination date remains due.

7. Liability

The Provider's liability is limited to intent and gross negligence. Liability for indirect damages, lost profits, and consequential damages is excluded to the extent permitted by law.

In particular, the Provider is not liable for:

  • Loss of telemetry data due to misconfiguration on the Customer side;
  • Service disruptions caused by force majeure or by upstream providers;
  • Damages arising from the Customer's failure to keep credentials and tokens confidential;
  • Loss of value due to changes in the Service's feature set within reasonable limits.

8. Data Protection and Subprocessors

The Customer remains the data controller within the meaning of the GDPR for all telemetry submitted to the Service. The Provider processes such data as a processor on behalf of the Customer. Details of the processing are set out in the Privacy Policy and, where required, in a separate Data Processing Agreement (DPA) made available on request.

The Provider engages the following subprocessors:

  • Stripe Payments Europe Ltd. (payment processing, EU)
  • The Provider's cloud-hosting partner for compute and storage (EU region)
  • The Provider's transactional email provider for verification and billing notifications

9. Term and Termination

Unless otherwise agreed, the Service is provided on a month-to-month basis and can be terminated by either party at the end of the current billing period. Paid annual plans run for the agreed term and renew automatically unless terminated with one month's notice.

Termination must be sent by email to mail@software.tirol.

After termination, telemetry stored in the account is retained for 30 days for export purposes and then deleted irrevocably.

10. Amendments

The Provider reserves the right to amend these Terms at any time. Changes will be communicated by email to the registered address. If the Customer does not object within 30 days, the amended Terms shall be deemed accepted.

11. Final Provisions

Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Innsbruck, Austria.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
